Vocal Video, Inc., a California corporation ("Vocal Video"), is committed to keeping any and all personal information collected from individuals that visit our Site and make use of our online facilities and Services accurate, confidential, secure, and private. Any term not defined herein shall have the meanings as set forth in the Terms of Service: https://vocalvideo.com/tos.

This Privacy Policy shall apply to Vocal Video, and thus it shall govern any and all data collection and usage thereof. Through the use of https://vocalvideo.com/ you are herein consenting to the following data procedures expressed within this agreement.

Vocal Video complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) (collectively, herein, the “DPF Principles”) as set forth by the U.S. Department of Commerce. Vocal Video has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU- U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Vocal Video has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. 1. Collection of Information

This Site collects various types of information, such as:

  • Voluntarily provided information, such as Submissions, including, but not limited to Respondent Materials and Customer Materials, which may include your name, address, email address, photo likeness, billing and/or credit card information etc., which may be used when you purchase products and/or Services and to deliver the Services you have requested.
  • Information automatically collected when visiting our Site, which may include cookies, third party tracking technologies and server logs.

Please rest assured that this Site shall only collect personal information that you knowingly and willingly provide by way of Submissions and other correspondence authorized by Vocal Video. It is the intent of this Site to use personal information only for the purpose for which it was requested and any additional uses specifically provided on this Site.

We may also gather information about the type of browser you are using, IP address or type of operating system to assist us in providing and maintaining superior quality service.

2. Use of Information Collected

Vocal Video may collect and may make use of personal information to assist in the operation of our Site and to ensure delivery of the Services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other Services that may be available to you from https://vocalvideo.com/.

Vocal Video may also be in contact with you with regards to completing surveys and/or research questionnaires related to your opinion of current or potential future Services that may be offered.

Vocal Video does not now, nor will it in the future, sell, rent or lease any of our customer lists, respondent lists, and/or names to any third parties.

3. Access and Disclosure to Third Parties

Before disclosing your personal information to a subcontractor or third-party agent, Vocal Video will obtain assurances from the recipient that it will: (a) use the personal information only to assist Vocal Video in providing the Services; (b) provide at least the same level of protection for personal information as required by the DPF Principles; and (c) notify Vocal Video if the recipient is no longer able to provide the required protections. Upon notice, Vocal Video will act promptly to stop and remediate unauthorized processing of personal information by a recipient. Vocal Video will remain liable for onward transfers to its subcontractors and third-party agents.

Vocal Video may disclose your personal information, without prior notice to you, only if required to do so in accordance with applicable laws and/or in a good faith belief that such action is deemed necessary or is required in an effort to:

  • Remain in conformance with any decrees, laws and/or statutes or in an effort to comply with any process which may be served upon Vocal Video, and/or our Site, including for the purpose of meeting national security or law enforcement requirements. To the extent permitted, Vocal Video will inform you before making such disclosure and provide you with a reasonable opportunity to object to such disclosure;
  • Maintain, safeguard and/or preserve all the rights and/or property of Vocal Video; and
  • Perform under demanding conditions in an effort to safeguard the personal safety of users of https://vocalvideo.com/ and/or the general public.
  • Facilitate or enter into a sale, merger or change in control of all or any part of our company or business or in preparation for any of these events.

To help us provide certain aspects of our Services, we use our affiliates and trusted key partners – in particular, we engage third parties to:

  • Facilitate the delivery of email and SMS messages to Customers and Respondents.
  • Facilitate Customers in making payments.
  • Deliver and help us track our marketing and advertising content.
  • Help us track website conversion success metrics.
  • Manage our customer support services to you.

Vocal Video will not otherwise disclose Personal Data to third parties.

4. Information You Share

Our Site and Services let you share information, including but not limited to Vocal Produced Videos, with others. Remember that when you share information publicly, it can be indexable by search engines. Our Services provide you with different options on sharing and deleting your content but we cannot delete content from search engines so you need to be careful about information you make public.

5. We Want to Communicate with You

We may occasionally send you notification emails about updates to our product, legal documents, offer customer support or marketing emails. Except for cases where we are required to do so by law (e.g. notifying you of a data breach), you shall have the opportunity to unsubscribe from receiving these messages free of charge.

6. Your Data, Your Rights

We can only identify you via your email address and we can only adhere to your request and provide information if we have personal data about you through you having made contact with us directly and/or you using our Site and/or Service.

You have the right to access the personal information you have provided to us. If such personal data is inaccurate or processed in violation of the DPF Principles, you may also request that such personal data be corrected, amended, or deleted. See also Section 8: Data Retention.

Where you have provided consent, you may withdraw it at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the Site and/or Services. You further agree that Vocal Video shall not be held liable with respect to any loss and/or damage to your personal data if you choose to withdraw consent.

In addition, you have the right to lodge a complaint with the data protection authority in your jurisdiction.

7. Cookies

We and our partners use cookies and similar technologies on our websites.

We use certain cookies, and here in our Privacy Policy, that you agree to when you use our Site and, in the case of some cookies, for legitimate interests of delivering and optimizing our Service (where the cookie delivers essential functionality). Cookies are small bits of data we store on the device you use to access our Services so we can recognize repeat users. Each cookie expires after a certain period of time, depending on what we use it for. We use cookies and similar technologies for several reasons:

  • For security reasons. We use cookies to authenticate your identity and confirm whether you are currently logged into Vocal Video or determine if an incident impacts you.

8. Data Retention

If you hold a Customer account with Vocal Video we do not delete the data in your account – you are responsible for and control the time periods for which you retain this data. There are controls in your account where you can delete data at the account level (all data in your account) and at the respondent level. If you are a Respondent, you will need to ask the Customer how long your responses will be stored in Vocal Video Services.

9. Data Storage and Transfer

Your information collected through our website may be stored and processed subject to Vocal Video's Terms of Service and Data Processing Addendum.

10. Children Under Age of 13

Vocal Video does not knowingly collect personal identifiable information from children under the age of thirteen (13) without verifiable parental consent. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system’s database. Anyone under the age of thirteen (13) must seek and obtain parent or guardian permission to use this Site.

11. Links to Other Web Sites

Our Site does contain links to affiliate and other websites. Vocal Video does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our Site and to read the privacy statements of each and every website that collects personally identifiable information. The aforementioned Privacy Policy applies only and solely to the information collected by our Site.

12. Security

Vocal Video shall endeavor and shall take every precaution to maintain adequate physical, procedural and technical security with respect to our offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure or modification of the User’s personal information under our control.

The company also uses Transport Layer Security (TLS) for authentication and private communications in an effort to build users’ trust and confidence in the internet and website use by providing simple and secure access and communication of credit card and personal information.

13. Changes to Privacy Policy

Vocal Video reserves the right to update and/or change the terms of our privacy policy, and as such we will post those change to our Site homepage at https://vocalvideo.com/, so that our Users are always aware of the type of information we collect, how it will be used, and under what circumstances, if any, we may disclose such information. If at any point in time Vocal Video decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall be promptly notified by email. Users at that time shall have the option as to whether or not to permit the use of their information in this separate manner.

14. Recourse, Enforcement & Liability

In compliance with the EU-U.S. DPF Principles, including the UK Extension of the EU-U.S. DPF Principles and the Swiss-U.S. DPF Principles, Vocal Video commits to resolve complaints about your privacy and Vocal Video’s collection or use of Personal Data transferred to the United States pursuant to this Policy.

European Union, Swiss, and United Kingdom individuals with DPF inquiries or complaints should contact Vocal Video by emailing legal@vocalvideo.com.

Vocal Video has further committed to refer unresolved privacy complaints under the DPF Principles to an independent recourse mechanism, Data Privacy Framework Dispute Resolution, operated by JAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://www.jamsadr.com/eu-us-data-privacy-framework for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not otherwise resolved by other redress mechanisms. For more information about binding arbitration, visit dataprivacyframework.gov.

The Federal Trade Commission has jurisdiction over Vocal Video’s compliance with the DPF Principles.

15. Acceptance of Terms

Through the use of this Site, you are hereby accepting the terms and conditions stipulated within the aforementioned Privacy Policy Agreement. If you are not in agreement with our terms and conditions, then you should refrain from further use of our Site. In addition, your continued use of our Site following the posting of any updates or changes to our terms and conditions shall mean that you are in agreement and acceptance of such changes.
